Davy Jones was appointed sales manager for a yacht business and a map company, under separate agreements, each of which authorised him to appoint sales representatives at the expense of the respective companies. Davy Jones sent a letter, on notepaper of the mapping company to Horatio Nelson appointing Nelson as a representative for both companies on stated terms and conditions as to salary and commission. This letter was signed “D Jones”. Nelson later sued Jones for payment of commission. Jones denied liability alleging that Nelson’s claim should have been directed against the companies, since Jones only acted as an agent.
What is the legal position?
