searay boats for sale
SOLD A BOAT AND FINANCED SOME OF IT NOW ITS BROKE DOWN.?
I Sold a 2001 searay boat ive had it for 1 year with no problems. 3 weeks after selling it the guy comes to me with problems in the engine.heres the kicker i never registered the boat so when i sold it i had to use the past sellers name on the paper work so the buyer could get a tag.i also financed about 1800 to him after his 5000 down payment. i still hold the title but the boat is in his name. do i have a leg to stand on with the money i financed him all we had was a verbal contract. or as he says he will bring the boat back and demand his 5000 back. what do i do,it was my first time selling anything so i just done what he said to do--the bill of sale also said i sold it to him for 500 dollars which he wrote,so his tag would not be very much--i know i messed up but what next.. This is a far more difficult legal problem than some of the answerer's think. From personal experience, when you sold the boat, unless you made a written contract that specifies that you are selling as is with no warranty and no return...... in some states like Florida ....he might be able to return the boat to you and demand his 5000 back. Depending on representations you made to him, or based on a test run of the boat, he might/ or might not have a case. So, all that other stuff is just stuff....... which could get you in trouble. Your holding the title is of no benefit.....it's in his name.....unless you put a lean on it for 1800 (which you didn't do because you sold it for 500) He can get a duplicate title..... and stiff you for the $1800. What I'd suggest is that you agree to go with him to a repair shop qualified to repair the engine, get and estimate on repairs, then negotiate a split on how much you might be willing to pay (reducing the $1800) he owes you. Be Careful. He can only get the $5000 back at this point.....not damages, You might come out ahead, taking the boat back and doing the repairs and reselling the boat for a higher price.....I hope this helps. EDIT Oh! don't take the boat back until you have a written understanding spelling out all of the details and a waver promising not to file legal action.
