house boat for sale
I am worried sick, my partner and I are needing to rent a house but I have a CCJ and 2 defaults.?
My partner has really good credit, we have rented for over 2 years and never missed a payment. However when I left my estranged husband he was made bankrupt, didn't pay the mortgage or utilities, he told me he had paid the mortgage and took my name off the utilities (my fault I should have done it, but didn't want to rock the boat) I didn't take my name of the mortgage because I didin't want to loose out on the equity in the property ( he has now moved out and the property is for sale). As a result I have a CCJ from 2006, thats when I left him so I can't remember details and the two defaults above. I did a credit score check and I have a score of 683 (poor). My partner will be renting the house in his name, he earns almost twice the required salary, has good credit scores and good refs. I needed to be credit checked too though and now I'm worried sick we'll end up loosing out on the property, we've done ten viewing and this was the only decent one.
If you explain your situation to the agent/landlord they should be able to grant you the property.
The key thing landlords are interested in is..
Will they pay the rent (you have no rent arrears)
If they don't, can I enforce a judgement against them? (You have equity in previous house, partner is employed)
Will they look after my property (presumably you have god landlord references)
If you are aked for a credit check and DONT reveal your CCJ, it is likely you would be refused.
If your partner rents the property in his name only, there is no reason in law why he shouldn't allow you to live there, however...
... Some landlords (wrongly) consider this as subletting and may not renew the contract at the end of the initial term
... If your name isn't on the tenancy, you would have almost no tenancy rights - in law you would be an "excluded occupier" or lodger.
